Terms and Conditions<\/h1>\n

1. Scope and provider<\/h2>\n

1.1 These Terms apply to all contracts and services of PSYSOULOGY LLC<\/strong> (the \u201cProvider\u201d), 1242 SW Pine Island Road, Ste 42-348, Cape Coral, FL 33991, USA, in connection with the Freieres Leben<\/strong> offering (freieresleben.com).<\/p>\n

1.2 Conflicting terms of the customer do not apply unless the Provider expressly agrees in text form.<\/p>\n

2. Subject matter<\/h2>\n

2.1 The Provider supplies coaching services<\/strong> in the field of personal development (service contract). The offering comprises in particular: one-to-one coaching on a time-account<\/strong> basis (prepaid minutes), fixed-term Deluxe Packages<\/strong> and individually produced add-on tools<\/strong>.<\/p>\n

2.2 Free content (e.g. a freely accessible YouTube video series) and a newsletter may also be offered; no contract for paid services arises in this respect.<\/p>\n

2.3 Sales are concluded by direct contract<\/strong> with the Provider. No online checkout is operated; the contract is formed in accordance with section 4.<\/p>\n

3. Description of services; no healthcare<\/h2>\n

3.1 Coaching serves personal development, orientation, reflection and goal work in the field of healthy relationships and life design.<\/p>\n

3.2 The services do not<\/strong> constitute medical, psychotherapeutic or healing activity. No diagnoses are made and no therapies are carried out. The content does not replace medical or psychotherapeutic treatment and is not aimed at persons in acute psychological crises or with conditions requiring treatment.<\/p>\n

4. Formation of contract<\/h2>\n

4.1 Any non-binding, free initial call (approx. 20 minutes) does not have the character of a contract.<\/p>\n

4.2 The customer places the order by e-mail<\/strong>, stating name and address. The Provider then sends an invoice (PDF)<\/strong> with an invoice number. The contract is formed when the invoice reaches the customer; performance (crediting the time account or making the deliverable available) follows receipt of payment.<\/p>\n

4.3 Payment is made by bank transfer<\/strong> (advance payment) unless otherwise agreed.<\/p>\n

5. Prices<\/h2>\n

5.1 All prices are final prices. Any taxes applicable to your transaction are shown on your invoice.<\/p>\n

5.2 Depending on your country\/state of residency, sales taxes may be added to a new subtotal. You can contact us for further questions.<\/p>\n

5.3 Services to business customers (B2B) are provided only upon separate agreement.<\/p>\n

6. Time account (prepaid coaching)<\/h2>\n

6.1 By booking a time account the customer acquires a balance of coaching minutes<\/strong> (prepaid). Services used are billed to the minute<\/strong>. Tickets\/bundles may be offered at tiered discounts. The time account is kept pseudonymised, encrypted and locally.<\/p>\n

6.2 No expiry:<\/strong> the balance does not expire; it remains until used and lapses only upon dissolution of the Provider\u2019s company. Statutory limitation rules remain unaffected.<\/p>\n

6.3 Transfer:<\/strong> the balance may be transferred to third parties only after prior consultation with, and consent of, the Provider.<\/p>\n

6.4 Cancellation before first use (outside any right of withdrawal):<\/strong> as long as no service has been drawn from the time account (\u201cfirst use\u201d) and any statutory right of withdrawal has already lapsed or expired, the customer may cancel. The Provider may retain a flat processing fee of 10% of the order value<\/strong>. The customer is entitled to prove that no loss or diminution in value, or a substantially lower one, has occurred; in that case the fee is reduced accordingly.<\/p>\n

6.5 After first use:<\/strong> once the first service has been drawn from the time account, a refund of the remaining balance is excluded; the remaining balance stays usable in accordance with section 6.2. Any statutory right of withdrawal still existing at that time remains unaffected (see Right of Withdrawal).<\/p>\n

7. Deluxe Packages<\/h2>\n

7.1 Deluxe Packages are fixed-term support packages<\/strong> with a clearly defined scope of services. The customer selects a term of one, two or three months<\/strong>. The respective scope (e.g. deep & intense sessions, regular sessions, alert calls, messenger\/mail enquiries, intermediate check-calls and \u2013 in the three-month package \u2013 an individual audio session\/PROSESSION) follows from the package description at the time of order.<\/p>\n

7.2 Services must be used within the selected term. Services not used expire at the end of the term<\/strong> with no claim to a refund or to making them up later. This time limit is part of the typical performance of the support package and is transparently disclosed to the customer at booking.<\/p>\n

7.3 Deluxe Packages contain no<\/strong> automatic renewal; they do not establish a continuing obligation, so no cancellation button is required.<\/p>\n

7.4 Alert calls and messenger\/mail enquiries are available on business days from 8 a.m. to 8 p.m. Each messenger\/mail enquiry is directed at one specific question and supplements the coaching without replacing it.<\/p>\n

8. Add-on tools (individually produced)<\/h2>\n

8.1 Add-on tools are services produced individually for the customer<\/strong> (e.g. as PDF or audio), made to the customer\u2019s specification or tailored to their process. Format and scope follow from the respective product description. Billing is by invoice; a discounted add-on rate may apply for customers in an ongoing engagement.<\/p>\n

8.2 As they are made-to-specification individual items, there is no right of withdrawal<\/strong> for EU\/EEA\/UK consumers (sec. 312g(2) no. 1 German Civil Code \/ Art. 16(c) Directive 2011\/83\/EU). Where, exceptionally, a non-individualised, standardised digital product is supplied, the right of withdrawal lapses under the conditions set out in the Right of Withdrawal.<\/p>\n

8.3 Individually produced tools and audio sessions are intended solely for the customer\u2019s personal use; redistribution, reproduction or other use is not permitted (see Copyright).<\/p>\n

9. Communication medium and own responsibility<\/h2>\n

9.1 Coaching sessions take place by default via Zoom<\/strong>. At the customer\u2019s express request, the customer may choose another medium on their own responsibility<\/strong> (telephone, Signal, Telegram, Threema).<\/p>\n

9.2 WhatsApp and Facebook Messenger are excluded by the Provider.<\/strong><\/p>\n

9.3 If the customer chooses a medium other than Zoom, they do so on their own responsibility; the associated data transfer to the respective provider and any data-protection consequences fall within the customer\u2019s sphere of responsibility. The Provider has no liability for the customer\u2019s choice of medium beyond the statutory limits.<\/p>\n

10. Right of withdrawal<\/h2>\n

For consumer contracts concluded at a distance, a statutory right of withdrawal exists as set out in the separate Right of Withdrawal<\/strong>, which forms part of these Terms. The right of withdrawal applies to consumers in the EU\/EEA and the UK; for consumers outside those territories, the cancellation provisions of these Terms apply.<\/p>\n

11. Copyright and restrictions on use<\/h2>\n

11.1 All content and materials are protected by copyright.<\/p>\n

11.2 The following are prohibited in particular: passing on to third parties; public communication; resale; reverse engineering; automated extraction (scraping); use for AI training or feeding into AI systems; creation of transcripts by AI.<\/p>\n

12. Technical requirements and duties to cooperate<\/h2>\n

The customer is responsible for: a stable internet connection; suitable hardware and software for the chosen communication medium; a working e-mail address; regular checking of the spam folder; their own data backup.<\/p>\n

13. Liability<\/h2>\n

13.1 The Provider is liable without limitation for intent and gross negligence and for injury to life, body and health.<\/p>\n

13.2 For slight negligence the Provider is liable only for breach of material contractual obligations (cardinal obligations) and limited to the foreseeable damage typical for the contract.<\/p>\n

13.3 There is no liability for server outages, cyber-attacks, force majeure, third-party disruptions, governmental measures and telecommunications failures. Liability for the customer\u2019s individual decisions based on the coaching content is excluded.<\/p>\n

14. Governing law<\/h2>\n

14.1 The law of the State of Florida applies, excluding the UN Convention on Contracts for the International Sale of Goods.<\/p>\n

14.2 For consumers with habitual residence in the European Union, the mandatory consumer-protection provisions of their state of residence remain unaffected (Art. 6 Rome I Regulation).<\/p>\n

15. Dispute resolution<\/h2>\n

The Provider is neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration board.<\/p>\n

16. Final provisions<\/h2>\n

16.1 Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions remains unaffected.<\/p>\n

16.2 Amendments and supplements require text form.<\/p>\n
